Rental Agreement Form
By renting from Magical Moments Photo Booth you are agreeing to these written terms and conditions. You are responsible for reading the entire document.
The following terms and conditions will set forth an agreement between the renter and Magical Moments Photo Booth
for photo booth services for the event. This written agreement sets forth the full written intention of both
parties and supersedes all other written and/or oral agreements between the parties.
AGREEMENT: Provider agrees to have a photo booth operational during this period. The client understands that all images from this booth are sent via WifI/LTE connection through text or email, and photos may be delayed to guests if the connection is lost or the signal is weakened. All photos taken at the event will be sent to guests once a strong connection is made. The quality of photos is subjective and not grounds for refunds. Our equipment is industry standard for the purpose of novelty photo booth rental service. Rentals are only between 11 AM - 11 PM and payment must be made beforehand if additional time is needed. Client acknowledges that any actions of the guests including but not limited to misuse of any equipment including props, backdrop, or stand by the client or client's guests including children in a manner that causes harm to another person is the sole responsibility of the said person. Client agrees that Magical Moments Photo Booth or its owners shall not be held liable or responsible for any actions of the guests. Event location must be accessible for photo booth delivery & setup 1 hour before the start of the event.
PAYMENT To reserve photo booth rental service for the event, a non-refundable deposit of $100 must be made prior to the event date. Service will not be rendered if full payment is not received prior to the event date. The remaining amount is due a week before the day of the Client's event. If extra time is required, payment must be completed before time can be provided for your event, this charge will be $50.00 per hour. We may not be able to provide extra hours if not previously arranged. We accept credit card payments through our website. we DO NOT accept Personal checks. WE CAN NOT SECURE YOUR DATE ON OUR CALENDARS UNTIL THE DEPOSIT HAS BEEN RECEIVED. Any parking fees required to allow access to the venue or required for delivery staff to remain at the event for the duration of the event or setup time must be paid by the client on the same contract invoice. Any payment for parking fees not received may delay the attendant and will be billed to the client after the event.
DATE CHANGES, CANCELLATIONS, & REFUNDS The $100 deposit is non-refundable. Any request for a date change must be made at least 15 days in advance of the original event date. Change is subject to photo booth availability and a new service contract must be made. If there is no availability for the alternate date the payment shall be refunded minus the deposit and event will be cancelled. At the sole discretion of Magical Moments Photo Booth, event rental may be canceled and prior payments will be fully refunded in the event that services cannot be rendered at all due to unforeseen circumstances on our part. Notification of such cancellation will be made as soon as possible and once refunded Magical Moments Photo Booth shall no longer be indebted to the client. Cancellations made by the client or due to insufficient or incorrect space after the staff has arrived at the venue will not be refunded. Refunds may take up to 14 days to be processed.
ACCESS, SPACE & POWER FOR PHOTO BOOTH Set up space must be indoors to protect our equipment from weather and sunlight: The Client shall provide Magical Moments Photo Booth with safe and appropriate working conditions and a solid floor. The Client will arrange an appropriate 8′ x 8′ space, with a minimum of 7.5′ of ceiling clearance for the Photo Booth at the event's venue. Client is responsible for providing 1 standard electrical outlet within 10ft of the booth for the Photo booth, or you must rent our portable battery pack to provide electricity to the photo booth. Any delay in the performance or damage to the photo booth equipment due to improper power is the responsibility of the client.
DAMAGE TO PROVIDER'S EQUIPMENT Client acknowledges that he or she is responsible for any damage or loss to the Provider's Equipment caused by a) Any misuse of the Provider's Equipment by Client or its guests, or b) Any theft or disaster, (including but not limited to rain, fire or flood, etc)
TRAVEL. If your event site is over 15 miles away from 48146, (our office location) a travel fee will apply. A fee of $1 per mile will be added to your bill.
MEDIA USAGE: The Client agrees to allow Magical Moments Photo Booth to use any recordings or images captured by the machine for advertising purposes. Magical Moments Photo Booth and its providers are released, discharged, and will be held harmless from any liability, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy. We respect your privacy so please let us know via email before your event if you would like your photos to be kept private and not used
ONLINE GALLERY/AUDIO GUEST BOOK FILES: A link with your photos/files will be sent to the client after the event. All uploaded photos and files may be deleted 3 months after the event.
HOLD HARMLESS The Client agrees to indemnify, defend, and hold harmless Magical Moments Photo Booth, its owners, employees, and affiliates from and against any and all claims, damages, injuries, or expenses arising from the use or operation of the photo booth or related equipment during the event. This includes, but is not limited to, personal injury, property damage, or equipment misuse by guests or attendees. The Client acknowledges that they are responsible for ensuring safe and appropriate use of the booth and equipment at all times.
MISCELLANEOUS TERMS If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the Client agrees to solve any arguments via arbitration.
